Proposal Update:
On Feb. 4, 2022, Cachet Developments Inc. withdrew their request for Council support of their request to the Province for a Minister's Zoning Order (MZO). They have indicated that they will work with the community, the Township, and the Region of Waterloo through the Municipal Comprehensive Review of the Region of Waterloo Official Plan process to pursue development plans for their property between Baden and New Hamburg.

Cachet Developments (NH) INC. and Cachet Developments (NH WEST) INC. had requested that the Township of Wilmot Council support their proposed MZO submission to the Province. If granted, the order would have automatically zoned their lands and allowed for the development of a new subdivision, which would include a mix of residential and commercial properties. |

What is a Minister’s Zoning Order (MZO)?
Section 47(1) of the Planning Act permits the Minister to exercise any of the powers granted to Councils by sections 34 (zoning), 38 (interim control) or 39 (temporary use) without the requirement to carry out public consultation. An MZO allows the Minister of Municipal Affairs and Housing to make a ruling on how a piece of land is to be used in the province. They can be an important tool to quickly advance key priorities, such as housing. However, they bypass any requirement for public consultation. Can an MZO be appealed? No. An MZO is not subject to appeal to the Ontario Land Tribunal. Who Initiates an MZO? MZO’s are initiated by, or on behalf of, land owners, who also submit the request to the Ministry of Municipal Affairs and Housing (MMAH) as it is a Provincial process. In the case of this MZO application, it has been initiated by Cachet Developments, not the Township. Cachet will also submit their application to the Minister What is the role of the municipality in the MZO process? When an MZO application is being submitted by a party other than a municipality, the local municipality is often asked if it will provide a letter of support to be submitted with the formal application to the minister.
